2. Scope and Acceptance

2.1 Applicability

These Terms and Conditions govern:

  • The use of the tratamentes.pt website
  • The provision of manual therapy services
  • Appointment scheduling through the platform

2.2 Acceptance

By using this website or scheduling an appointment, the user fully accepts these Terms and Conditions. If you do not agree with any provision, you should refrain from using our services.

3. Description of Services

3.1 Nature of Services

TrataMentes provides manual therapy and wellness services, including:

  • Therapeutic massage
  • Relaxation massage
  • Visceral therapy
  • Manual lymphatic drainage

3.2 Important Limitations

Our services:

  • Are NOT medical acts
  • Do NOT replace medical diagnosis or treatment
  • Do NOT include medication prescription
  • Are wellness and quality of life improvement services

3.3 Medical Recommendation

We recommend that you consult a doctor before starting treatments if:

  • You have pre-existing health conditions
  • You are pregnant
  • You are taking medication
  • You have doubts about the suitability of treatment

4. Scheduling and Appointments

4.1 Booking System

Appointments are made through:

  • Online platform (buk.pt/tratamentes)
  • WhatsApp (+351 937 543 312)
  • Phone (+351 937 543 312)

4.2 Confirmation

Appointments are confirmed by email or message. The booking is only valid after confirmation.

4.3 Required Information

To schedule an appointment, you must provide:

  • Full name
  • Phone contact
  • Email
  • Reason for appointment (optional)

5. Cancellation and Refund Policy

5.1 Booking Deposit

When making a booking, 50% of the session value is automatically charged as a booking deposit (see Section 6.4).

5.2 Cancellation by Client

a) Cancellation more than 24 hours in advance

  • Refund: 100% of the deposit paid
  • The client may choose to reschedule to another date at no additional cost

b) Same-day cancellation

  • Refund: Subject to case-by-case evaluation
  • The reasons provided will be considered (medical emergency, force majeure, etc.)
  • Recommendation: Instead of cancelling, we suggest rescheduling to another date

c) No-show

  • Refund: No refund of the deposit paid
  • Failure to attend without prior notice results in total loss of the booking deposit (50%)

5.3 Rescheduling

  • More than 24 hours in advance: Free, without any penalty
  • Same day: Subject to availability and evaluation

5.4 Cancellation by Provider

We reserve the right to cancel or reschedule appointments in cases of:

  • Force majeure
  • Therapist illness
  • Conditions that make safe service provision impossible

In case of cancellation on our part, rescheduling or full refund will be offered.

6. Prices and Payments

6.1 Prices

Current prices are available at:

  • Website (tratamentes.pt/services)
  • Booking platform
  • Upon direct enquiry

6.2 Price Changes

We reserve the right to change prices. Changes do not affect already confirmed bookings.

6.3 Payment Methods

We accept:

  • Cash
  • MB Way
  • SPIN
  • Bank transfer
  • Debit/credit card (subject to terminal availability)
  • Bitcoin (BTC)

6.4 Payment at Booking

When making a booking through the buk.pt platform, 50% of the session value is automatically charged as a booking deposit. This amount secures your appointment and is deducted from the total amount due.

The remaining value (50%) is paid at the end of the session, in person.

6.5 Deposit Refund

The refund of the booking deposit (50%) follows the rules established in Section 5 (Cancellation Policy):

  • Cancellation up to 24 hours before: Full refund of the deposit
  • Same-day cancellation: Subject to evaluation (see Section 5.2)
  • No-show: No refund

6.6 Invoicing

All sessions are invoiced. The invoice is issued with the client’s tax number when requested at the time of payment.

7. Client Responsibilities

The client agrees to:

7.1 Truthful Information

  • Provide accurate information about your health status
  • Inform about medical conditions, allergies or medication
  • Communicate any relevant changes

7.2 During the Session

  • Arrive on time (10-minute tolerance)
  • Communicate any discomfort during treatment
  • Follow the therapist’s instructions

7.3 Contraindications

You should not schedule a session if:

  • You have a fever or active infection
  • You have open wounds in the area to be treated
  • You are in an acute phase of illness

8. Provider Responsibilities

TrataMentes commits to:

8.1 Service Quality

  • Provide services with professionalism and competence
  • Maintain up-to-date training
  • Use safe and recognised techniques

8.2 Hygiene and Safety

  • Keep spaces clean and sanitised
  • Use disposable materials when appropriate
  • Comply with health and safety standards

8.3 Confidentiality

  • Maintain client information confidential
  • Protect personal data in accordance with GDPR
  • Not share information without consent

9. Limitation of Liability

9.1 Exclusion of Liability

TrataMentes is not liable for:

  • Unachieved results (results vary from person to person)
  • Worsening of pre-existing conditions not communicated
  • Injuries resulting from incorrect information provided by the client
  • Indirect or consequential damages

9.2 Maximum Liability

In case of proven liability, the maximum compensation will be limited to the amount paid for the session in question.

9.3 Force Majeure

We are not responsible for non-compliance caused by events beyond our control (force majeure).

10. Intellectual Property

10.1 Website Content

All website content is the property of TrataMentes or duly licensed:

  • Texts and articles
  • Images and photographs
  • Logos and trademarks
  • Design and layout

10.2 Permitted Use

The user may:

  • View content for personal use
  • Share website links
  • Print pages for personal use

10.3 Prohibited Use

It is forbidden to:

  • Copy or reproduce content without authorisation
  • Use content for commercial purposes
  • Modify or create derivative works
  • Remove copyright notices

11. Website Use

11.1 Acceptable Use

The user agrees to:

  • Use the website lawfully
  • Not attempt to access restricted areas
  • Not introduce viruses or malicious code
  • Not overload the servers

11.2 Availability

We do not guarantee that the website will always be available. Interruptions may occur for maintenance or technical reasons.

14. Applicable Law and Jurisdiction

14.1 Applicable Law

These Terms are governed by Portuguese law.

14.2 Competent Court

For dispute resolution, the courts of Lisbon have jurisdiction, with waiver of any other.

15. Changes to Terms

15.1 Right to Change

We reserve the right to change these Terms at any time.

15.2 Notification

Significant changes will be communicated through the website. Continued use after changes constitutes acceptance of the new terms.

16. Final Provisions

16.1 Severability

If any clause is deemed invalid, the remaining clauses remain in force.

16.2 Non-Waiver

Failure to enforce any right does not constitute a waiver of that right.

16.3 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties.
